Many students get summer jobs. It’s a great way to earn extra spending money or to save for later. Here are some tips for students with summer jobs:

Withholding and Estimated Tax. If you are an employee, your employer normally withholds tax from your paychecks. If you are self-employed, you may be responsible for paying taxes directly to the IRS. One way to do that is by making estimated tax payments on set dates during the year. This is essentially how our pay-as-you-go tax system works.

New Employees. When you get a new job, you need to fill out a Form W-4, Employee’s Withholding Allowance Certificate. Employers use this form to calculate how much federal income tax to withhold from your pay. The IRS Withholding Calculator tool on IRS.gov can help you fill out the form.

Self-Employment. Money you earn working for others is taxable. Some work you do may count as self-employment. These can be jobs like baby-sitting or lawn care. Keep good records of your income and expenses related to your work. You may be able to deduct those costs. A tax deduction generally reduces the taxes you pay.

Tip Income. All tip income is taxable. Keep a daily log to report your tips. You must report $20 or more in cash tips received in any single month to your employer. And you must report all of your yearly tips on your tax return.

Payroll Taxes. You may earn too little from your summer job to owe income tax. But your employer usually must withhold Social Security and Medicare taxes from your pay. If you’re self-employed, you may have to pay them yourself. They count for your coverage under the Social Security system.

Newspaper Carriers. Special rules apply to a newspaper carrier or distributor. If you meet certain conditions, you are self-employed. If you do not meet those conditions, and are under age 18, you may be exempt from Social Security and Medicare taxes.

ROTC Pay. If you’re in ROTC, active duty pay, such as pay you get for summer advanced camp, is taxable. Other allowances you may receive may not be taxable, see Publication 3 for details.

Use IRS Free File. You can prepare and e-file your tax return for free using IRS Free File, available only on IRS.gov. You may not earn enough money to be required to file a federal tax return. Even if that is true, you may still want to file. For example, if your employer withheld income tax from your pay, you will have to file a return to get a tax refund.

​You have not filed your tax returns with the IRS in years, and want to put that behind you and make amends with the IRS? The good news is that the IRS does not require you to go back 20 years, or even 10 years on your un-filed tax returns.
In most cases, the IRS requires you to go back and file your last six years of tax returns to get in their good graces.  And then, to make arrangements on what is owed.

The six year enforcement period for delinquent returns is found in IRS Policy Statement 5-133 and Internal Revenue Manual 1.2.14.1.18. Part of the reason the IRS requires six years is manpower – the IRS cannot administer and staff the enforcement of un-filed tax returns going back as far as 10 or 20 years.  And believe it or not, the IRS’s records rarely, if ever, go back that far.  

The IRS is looking to draw a line in the sand that is consistent with their internal resources, and at the same time secure a good faith effort at compliance from taxpayers to get current.  And that line in the sand is six years. Not filing your tax returns is most always a civil issue (not criminal) that simply requires (1) filing the last six years’ tax returns and (2) making arrangements with the IRS to repay or settle what you owe. If you don't have all the records to prepare the returns, the IRS will often have copies of your W2s, 1099s, etc.  

There are also methods to recreate your income and business expenses if your records are incomplete – one way, for example, is to determine your living expenses for any year you did not file.  You likely earned at least what you spent, and that forms a basis to recreate your income for a good faith tax return filing. You do not have to be held back by un-filed tax returns.  The path to a fresh start is the last six years’ of returns. Why be in a state of fear and inaction when you can get this behind you and move on?  It can actually be more manageable than you may think.

1) OWING THE IRS YEAR AFTER YEAR: Do you to owe the IRS year after year?  The is called “pyramiding” by the IRS – the pyramid of your tax debts grows bigger.  The IRS can work with us if we stop the problem – what’s done is done.  But not getting into compliance and paying taxes going forward results in little mercy from the IRS.  Simply put, there is no negotiating to stop them when the problem has not stopped.

If you are self-employed, that means making estimated tax payments.  To do that, I recommend that we open up a new, separate bank account, and name it your estimated tax account.  Every time you get paid from a customer, we want to take a percent of that payment off the top and escrow it in your estimated tax account.  That percent is simple:  It is calculated on the ratio of your gross income to your taxes.  For example, you are paid $100,000 gross in a year, and that results in a $10,000 in taxes owed to the IRS, your tax rate is 10% of your gross income.

So every time you get paid, 10% of that check would get set aside for the IRS in the estimated tax account.  You pay as you go, pay as you get paid. Demonstrating to the IRS that you are setting money aside in an estimated tax account truly can take the sting out of past mistakes.



2. UN-FILED TAX RETURNS: If you have un-filed tax returns, the IRS will not hold back until you get in compliance. This is like not paying year after year.  An end has to be put on the problem to negotiate out of it.  If you have unfiled tax returns, the IRS will not relent until you get them filed.  And how does the IRS get your attention to get those returns filed?  They will levy your wages and bank accounts.

If you do not file the returns, the IRS has the law on its side in being able to start an investigation and prepare the returns for you.  The IRS calls this a Substitute for Return.  It is an IRS estimate of your tax liability, and usually result in you owing much, much more than if you filed the return on your own.  The good news is that in most circumstances the IRS will still accept the original return after they have filed a Substitute for Return.  But problems with getting your returns in is a sure-fire way to provoke the IRS into levying you.

Despite IRS claims that auditors cant negotiate. Give-and –take is part of the process.  An IRS Auditors job performance is based largely on how many cases closed – marked at “agreed”. The Auditors wants you to consent to their findings and not appeal or go to Tax Court.  This gives you negotiating power. This means the auditor wants your signature so badly she will allow bogus business expenses or overlook unreported income. Here is one negotiating strategy.

1)  DON’T JUST SIT THERE LIKE A “MUGU”: Keep asking the auditor about disallowances she is considering as the audit progresses or they won’t tell you what’s on their mind so you can be in the dark until you get the examination report. Don’t let an auditor take the easy way out – make her face and justify her actions.  In turn, you can argue your position right there and then. If she plans to make an adjustment because you didn’t produce records, you can ask for time to find or reconstruct the documents.  For Example:

A. The IRS Auditors tells Michael, an SEO consultant, the he is disallowing his deductions for the theft of his computer.  Michael’s reason is that there is no documentation for the loss. Michael should instead get a police report for the Auditor.

B. The Auditor wasn’t convinced that it was necessary for Mr. Joe to buy a $50,000 airplane for his subcontracting business. Mr. Joe could get a letter from Cox, the general contractor who hired him, saying he hired Mr. Joe to work on a project in a remote area inaccessible by car.

NOTE: Keep in mind, the difference between arguing and negotiating.  Negotiating is the art of meeting in the middle.  For example:  Let’s say you lost all your paperwork for a $600 office supply deduction. The auditor proposes to disallow 100% of the deduction. You can negotiate like “Since I made a profit and maintained an office, I must have bought office supplies. I lost my receipts, but my reconstruction of expenses is reasonable. I should be allowed at least 50%."

You are not required to go through the IRS Appeals Process before going to court. If you don’t appeal or do but are not happy with the outcomes, you can go to one of three courts:

1. United States Tax Court
2. United States District Court
3. Court of Federal Claims.


Almost everyone chooses Tax Court, for two good reasons:

1. The District and Claims Court require you to pay the tax first and then sue for a refund.
2. Fewer people succeed in District and Claims Court.
Tax court on the other hand allows you to contest an audit for a small filing fee and offers a more reasonable chance of success.

TAX COURT:
The chances of at least a partial victory is pretty good: Over half of those filing in Tax Court either settle with the IRS Lawyer before trial or get some reduction in court. For instance, the judge may uphold the IRS on a tax adjustment, but knock off all the penalties.

In cases under $50,000, about 47% of taxpayers win at least partial victories over the IRS Auditor. In Larger cases, 60% of taxpayers come out ahead. However, less than 10% win a total victory in Tax Court.

The number of different tax code penalties is staggering but here are three to worry about:

1. INACCURACIES:
The IRS can hit you with a 20% penalty if you were negligent (unreasonably careless) or substantially understated your taxes. This "accuracy-related" penalty is applied when you cant prove a deduction on an audit, or you didn't report all of your income and the IRS discovers it.

2. CIVIL PENALTIES:
If the IRS finds that you under-reported your income with a fraudulent intent (it doesn't look like an honest mistake), a fine of 75% can be added. You may also be charged with the crime of tax fraud, which is a more rare.

3. LATE FILING:
If you are late in filing your income tax return or other forms. The IRS can penalize you an additional 5% per month on any balance. However, this penalty can be only for the first five months following the tax returns due date, up to a 25% maximum. If there is no balance due on a late return, the IRS cant impose this stiff penalty but may be able to tack on lesser penalties.

  • Review Your Eligibility. If you worked and earned under $53,267, you may qualify for EITC. If your income or family situation has changed, you should review the EITC eligibility rules. You might qualify for EITC this year even if you didn’t in the past. If you qualify for EITC you must file a federal income tax return and claim the credit to get it. This is true even if you are not otherwise required to file a tax return. Don’t guess about your EITC eligibility. Use the EITC Assistant tool on IRS.gov. The tool can help you find out if you qualify for the credit. It can also estimate the amount of your EITC.

  • Know the Rules. You need to understand the rules before you claim the EITC, to be sure you qualify. It’s important that you get this right. Here are some factors you should consider:
    • If you are married and file a separate return you do not qualify for EITC.
    • You must have a Social Security number that is valid for employment for yourself, your spouse, if married, and any qualifying child listed on your tax return.
    • You must have earned income. Earned income includes earnings from working for someone else or working for yourself.
    • You may be married or single, with or without children to qualify. If you don’t have children, you must also meet age, residency and dependency rules. If you have a child who lived with you for more than six months of 2015, the child must meet age, residency, relationship and the joint return rules to qualify.
    • If you are a member of the U.S. Armed Forces serving in a combat zone, special rules apply.

  • Lower Your Tax or Get a Refund. If you qualify for EITC, you could pay less federal tax, no tax or even get a refund. EITC could be worth up to $6,242. The average credit was $2,447 last year.

Most people can claim an exemption on their tax return. It can lower your taxable income. In most cases, that reduces the amount of tax you owe for the year.

Here are the top 7  tax facts about exemptions to help you file your tax return.
  1. E-file Your Tax Return.  Easy does it! Use IRS E-file to file a complete and accurate tax return. The software will help you determine the number of exemptions that you can claim. E-file options include free Volunteer Assistance, IRS Free File, commercial software and professional assistance.

  2. Exemptions Cut Income.  There are two types of exemptions. The first type is a personal exemption. The second type is an exemption for a dependent. You can usually deduct $4,000 for each exemption you claim on your 2015 tax return.

  3. Personal Exemptions.  You can usually claim an exemption for yourself. If you’re married and file a joint return, you can claim one for your spouse, too. If you file a separate return, you can claim an exemption for your spouse only if your spouse:
    • Had no gross income,
    • Is not filing a tax return, and
    • Was not the dependent of another taxpayer.

  4. Exemptions for Dependents.  You can usually claim an exemption for each of your dependents. A dependent is either your child or a relative who meets a set of tests. You can’t claim your spouse as a dependent. You must list the Social Security number of each dependent you claim on your tax return. For more on these rules, see IRS Publication 501, Exemptions, Standard Deduction, and Filing Information. Get Publication 501 on IRS.gov. Just click on theForms & Pubs tab on the home page.

  5. Report Health Care Coverage. The health care law requires you to report certain health coverage information for you, your spouse and any dependent that you claim on your return. Theindividual shared responsibility provision requires you and each member of your family to either:
    • Have qualifying health insurance, called minimum essential coverage
    • Have an exemption from this coverage requirement, or
    • Make a shared responsibility payment when you file your 2015 tax return.

6. Some People Don’t Qualify. You normally may not claim married persons as dependents if they file a joint return with their spouse. There are some exceptions to this rule.

7. Dependents May Have to File.  A person who you can claim as your dependent may have to file their own tax return. This depends on certain factors, like total income, whether they are married and if they owe certain taxes.

FIVE TIPS ON WHETHER TO FILE A 2015 TAX RETURN - ADVANCE TAX RELIEF

Most people file a tax return because they have to, but even if you don’t, there are times when you should. You may be eligible for a tax refund and not know it.
Here are five tips to help you find out if you should file a tax return:

1)General Filing Rules.
  Whether you need to file a tax return depends on a few factors. In most cases, the amount of your income, your filing status and your age determine if you must file a tax return. For example, if you’re single and under age 65 you must file if your income was at least $10,300. Other rules may apply if you’re self-employed or if you’re a dependent of another person. There are also other cases when you must file. Go to IRS.gov/filing to find out if you need to file.

2)Tax Withheld or Paid.
  Did your employer withhold federal income tax from your pay? Did you make estimated tax payments? Did you overpay last year and have it applied to this year’s tax? If you answered “yes” to any of these questions, you could be due a refund. But you have to file a tax return to get it.

3)Earned Income Tax Credit.  Did you work and earn less than $53,267 last year? You could receive EITC as a tax refund, if you qualify, with or without a qualifying child. You may be eligible for up to $6,242. Use the 2015 EITC Assistant tool on IRS.gov to find out if you qualify. If you do, file a tax return to claim it.

4)Additional Child Tax Credit.  Do you have at least one child that qualifies for the Child Tax Credit? If you don’t get the full credit amount, you may qualify for the Additional Child Tax Credit.

5)merican Opportunity Tax Credit.  The AOTC is available for four years of post secondary education and can be up to $2,500 per eligible student.  You, your spouse or your dependent must have been a student enrolled at least half time for at least one academic period. Even if you don’t owe any taxes, you still may qualify. You must complete Form 8863, Education Credits, and file it with your return to claim the credit.
